On 11-3-22 at 0745 hours while performing HATS Category III – Water and Feed Availability on 17 beef, IIC observed the following noncompliance: There was water in the water troughs, but no feed was observed in the pens. The cattle had been at the establishment since Tuesday 11-1-22 and no feed was observed the previous day either. IIC informed REDACTED Est. Manager of the lack of feed and shared that this was noncompliant and that an NR would be written for regulation 313.2(e): animals shall have access to water in all holding pens and, if held longer than 24 hours, access to feed. Animals shall have access to feed when held more than 24 hours in the holding pens.

On October 19, 2022, at approximately 0947 hours, while verifying HATS Category VIII – Stunning Effectiveness, IIC observed a Longhorn steer being loaded into the restrainer. He was unable to get his horns through the head catch so was left unrestrained within the restrainer. IIC left the area per firearm safety protocols. Upon hearing the firearm discharge, IIC looked around the corner to see the steer still standing within the restrainer. No vocalization was made by the steer. The plant employee immediately yelled for a second shot, so IIC again left the area. When IIC returned to the room following the second discharge sound, the steer was recumbent on the ground and noted to be unconscious by a lack of palpebral or corneal reflexes. U.S. Reject tag 305796was placed on the head catch of the restrainer and the kill floor manager REDACTED was notified of the forthcoming noncompliance report. This is not in compliance with 9 CFR 313.16(a)(1). Postmortem examination revealed two wounds with only a couple mm of tissue between them in the center of the forehead. Both stun attempts were made using the same 12-gauge shotgun.
